1. Acceptance of Terms
By accessing and using the services of Muthaiga Travel Limited ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you must not use our services.
We reserve the right to modify these Terms at any time. Your continued use of our services following any changes constitutes your acceptance of the new Terms.
2. Booking and Reservations
2.1 Booking Process
All bookings are subject to availability and acceptance by us. A booking is only confirmed when we issue a written confirmation or agreed agreements.
2.2 Pricing
All prices are subject to change without notice. Prices are based on rates in effect at the time of booking and may be subject to chnage due to currency fluctuations, fuel surcharges, government taxes or other factors beyond our control.
2.3 Payment Terms
A deposit is required to secure hotel reservations. The balance must be paid no later than 15 days before departure. For bookings made within 15 days of departure, full payment is required at the time of booking.
2.4 Cancellations and Refunds
Cancellation fees apply as follows:
- More than 45 days before departure: Loss of deposit
- 30-45 days before departure: 50% of total cost
- 15-29 days before departure: 75% of total cost
- Less than 15 days before departure: 100% of total cost
Some suppliers may impose stricter cancellation policies which will be communicated at the time of booking.
3. Travel Documents and Requirements
3.1 Passports and Visas
It is your responsibility to ensure you have valid passports, visas, and other required travel documents. We are not responsible for any denial of entry or transit resulting from improper documentation.
3.2 Health Requirements
You are responsible for meeting all health requirements, including vaccinations, for your destinations. Consult your physician for current recommendations.
3.3 Travel Insurance
We strongly recommend comprehensive travel insurance covering cancellation, medical expenses, personal liability, and loss of personal items. Some destinations may require proof of insurance.
4. Changes and Amendments
4.1 Changes by You
Requests for changes to confirmed bookings must be made in writing. We will make reasonable efforts to accommodate changes but cannot guarantee availability. Change fees may apply.
4.2 Changes by Us
We reserve the right to modify itineraries, accommodations, or transportation as necessary due to circumstances beyond our control. We will provide comparable alternatives when possible.
4.3 Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, terrorism, pandemics, or government actions.
5. Liability and Responsibility
5.1 Our Liability
We act as an agent for various travel service providers. Our liability is limited to arranging services and we are not responsible for acts or omissions of third-party providers.
5.2 Your Responsibilities
You are responsible for:
- Providing accurate information during booking
- Complying with all laws and regulations of visited countries
- Behavior that does not endanger others or property
- Any additional costs incurred due to your actions
5.3 Limitation of Liability
Our maximum liability for any claim related to our services is limited to the amount paid for the affected service.
6. Website Use
6.1 Intellectual Property
All content on our website, including text, graphics, logos, and images, is our property or licensed to us and protected by copyright laws.
6.2 Prohibited Uses
You agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Use automated means to extract data from our website
- Interfere with the proper working of our website
7. Privacy
Your use of our services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
